• INTELLECTUAL AND ARTISTIC WORKS
Works: All kinds of intellectual and artistic works of science, literature, music, fine arts, or cinema works that bear the characteristics of its owner.
Legislation of Intellectual and artistic works: Bears all the rules about works, their owners' rights and their protection. The rights on intellectual and artistic works, protects its owner’s material rights against violation and exploitation; in addition guaranties the owner of the works possibility of gaining economical benefits over his works; prevents publicisitation or changing of the works without its owners consent and its presentation to the public depending on the wish of the owner of the works by the owner’s name, pen name or anonymously. It guaranties material and moral rights of the owner over his works.
• KINDS OF INTELLECTUAL AND ARTISTIC WORKS
1. Scientific and Literature Works
According to Law of Intellectual and Artistic Works the works with the properties given below are accepted as Scientific and artistic works.
- Any works that are expressed orally or in written form.
- Computer software in any form and their draft designs as long as it will became a computer software in the next phase; (including the thoughts and principles of the bases of the database, thoughts and principles that would be the basis of a computer programs any element wont be accepted as Works).
- All kinds of dances, written cerography, Pantomimes, and similar non-verbal stage works.
- Except for fine arts, all kinds of technical and scientific photograph works, all maps, plans, projects, models and similar objects concerning geography and topography, all kinds of architectural and urban designs and projects, architectural models, industry, environment and stage design and projects,
2. Musical Works
The Law of Intellectual and Artistic Works accepts all kinds of verbal and non-verbal compositions as musical works.
3. Works of Fine Art
The Law of Intellectual and Artistic Works accepts the following works as works of fine art:
- Having aesthetic qualities in Law of Intellectual and Artistic Works;
- Oil pants and water color paintings,
- All kinds of pictures, designs, and pastels,
- Engravings, calligraphy, and ornamenting
- Works that are drawn or attached to minerals, rock, wood by engraving, carving or inlaying, calligraphy, serigraphy
- Statues, embossing, and engravings
- Works of architecture
- Hand works and small works of art
- Miniatures and ornamenting products
- Textile fashion designs
- Photographic works and slides
- Cartoons
- All kinds of typecasting
4. Works of Cinema
According to Law of Intellectual and Artistic Works all kinds of artistic, scientific, didactic and technical or films that show daily life or cinema films, without considering the material it is formed of, that can be shown electronically or mechanically or similar devices, silent or sound, the series of movements related with each other are accepted as works of cinema.
5. Processed and Collected
According to Law of Intellectual and Artistic Works the following works are accepted as Processed and Collected Works
- Translations
- Transformation of a novel, poem, theatre to another form of literature
- To make films out of a musical, fine art, scientific and literature works and put it in a form suitable to be broadcasted by radio or television.
- Musical arrangements and orders
- Transformation of works of fine arts from one order to another
- Collecting all the works or works of the same kind of an owner of the works as complete works.
- Collecting or electing works in a certain plan or special aim.
- To prepare a - Explanation, annotation or summarizing a work that belongs to another person.
- Adaptation, arrangement or making any changes in a computer software
- Date bases that are collected for a certain aim and with a special plan and could be read with a device (However the protection given here can not be extended for protection of the data and material that are present in the database).
- Processing that is formed without harming the rights of the owner and carrying owners' specifications.
6. Computer Programs
Law of Intellectual and Artistic Works accepts a computer program as a software that arranges a series of computer orders so that a computer performs a special task or a preparatory work that forms and develops this series of orders.
7. Publicized and Published Works
Works that are presented to the public with the consent of its owner are accepted to be publicized.
If the copes of a work are sold or distributed with the consent of its owner that work is accepted as published.
Article 3 of Press Law No 5680 is reserved.
• RIGHTS OF THE OWNER OF THE WORKS
Owner of the works is the person who has created that works.
Material rights
a) Processing right
b) Copying right
c) Distributing Right
d) Representing right
e) Publicizing right to the public with signs, audio and or visual transporting devices
f) Share and pursuit right
Moral Rights
a) Authority of presenting to public
b) Authority of giving a name
c) Authority of banning to make alterations on the works
d) Right of possession and possessor.
• CIVIL AND PENAL SUITS
Civil suits
Civil suits defined in 5846 Numbered Law of Intellectual and Artistic Works are divided to three:
- Suits for removing the violation
- Suits for preventing the violations
- Material and moral compensation suits
Penal Suits
Penal procedure can be started against violation of material and moral rights of the owner.
