Differences Between Utility Model and Patent Certificates

Patent and utility model are intellectual property rights that protect inventions. However, there are significant differences in the application process, scope of protection, and validity period.

  1. Requirement to Overcome the Known State of the Art
    • Patent: The invention must overcome the known state of the art.
    • Utility Model: This criterion is not required.
  2. Protection Period
    • Patent: Protected for 20 years.
    • Utility Model: Protected for 10 years.
  3. Research and Examination Reports
    • Patent: Research and examination reports are prepared by the Turkish Patent and Trademark Office (TÜRKPATENT) using international patent databases.
    • Utility Model: Only a research report is provided; no examination report is issued.
  4. Registration Process and Cost
    • Patent: The registration process can take approximately 3 years and is more costly.
    • Utility Model: The registration process is completed within 1-1.5 years and is less costly.
  5. Ability to Obtain Additional Documents
    • Patent: Additional patent certificates can be obtained.
    • Utility Model: Additional utility model certificates cannot be issued.
  6. Excluded Topics
    • Patent: ✅ Methods (procedures) and products obtained by these methods can be protected.
    • ✅ Pharmaceutical substances can be protected.
    • ✅ Biotechnological inventions can be protected.
    • ✅ Chemical and biological substances can be protected.

 

Utility Model:

  • Methods and products obtained through methods cannot be protected.
  • Pharmaceutical substances cannot be protected.
  • Biotechnological inventions cannot be protected.
  • Chemical and biological substances cannot be protected.
