Patent / Utility Model and Other Transactions
Patent and utility model rights are not limited to the application and registration process. Updates such as address, title, type changes, transfer through inheritance, transfer, and licensing transactions must be officially recorded with the Turkish Patent and Trademark Office (TÜRKPATENT).
1. Address Change
✅ When the address of the patent/utility model owner changes, this change must be reported to the Turkish Patent and Trademark Office and registered in the Registry.
✅ The address change must be made for all patents/utility models registered or in the application stage under the same patent/utility model owner's name.
2. Title Change
✅ When there is a change in the title of the patent/utility model owner, this change must be reported to the Turkish Patent and Trademark Office.
✅ The title change must be updated for all patents/utility models registered or in the application stage under the same patent/utility model owner's name.
3. Change of Type (Change of Company Type)
✅ If the type of the company (e.g., LTD, A.Ş.) of the patent/utility model owner changes, this change must be reported to the Turkish Patent and Trademark Office.
✅ A change of type must be made for all patents/utility models registered or in the application stage.
4. Transfer by Inheritance
✅ In the event of the death of the patent/utility model owner, these rights are transferred to the heirs.
✅ Patent/utility model rights transferred by inheritance must be reported to the Turkish Patent and Trademark Office on behalf of the heirs.
5. Transfer (Transfer of Ownership Rights)
✅ The patent/utility model owner can transfer their registered rights to third parties.
✅ Except for transfers made by court decision, patent/utility model transfers must be done through a written transfer agreement.
✅ The transfer must be reported to the Turkish Patent and Trademark Office and recorded in the Registry.
6. Licensing (Right to Use)
✅ The right to use a registered patent/utility model can be granted to third parties through a license.
✅ The license agreement must be reported to the Turkish Patent and Trademark Office and recorded in the Registry.
