Circumstances for Invalidity of a Design Registration Certificate
Competent courts can declare a design registration certificate invalid if certain conditions are met.
The main circumstances that may lead to the cancellation of a design registration are:
1️⃣ Failure to Meet Protection Criteria
✔ If it is proven that the design does not meet the criteria of novelty and distinctiveness, the registration may be declared invalid.
2️⃣ Violation of Ownership Rights
✔ If it is proven that the actual owner of the design is another person or persons, the design registration may be canceled.
3️⃣ Invalidity Due to Prior Designs
✔ If a design that is identical or similar to the design was made publicly available before the application date, the court may decide that the registration is invalid.
