Protection Period and Renewal Process of Registered Designs

Registered designs are protected for a period of 5 years from the application date. However, this period can be renewed in 5-year increments, extending the protection up to a total of 25 years.

In order to extend the protection period, the design rights holder or their authorized representative must submit a renewal request and pay the renewal fee.

The renewal process must be carried out within 6 months before the expiration date of the protection period.

What Happens if the Renewal Period is Missed?

If no action is taken within the renewal period, an additional 6-month extension is granted by paying an extra fee.
This extension period starts from the day the registration expires.
After the renewal process is completed, it is recorded in the register and published in the Official Bulletin.

 

What Happens if the Renewal Process is Not Done?

The design rights for designs that are not renewed expire on the date the protection period ends.
In this case, the design becomes part of the public domain and can be freely used by anyone.
