Work Owner and Rights
The work owner is the person who creates the intellectual and artistic work, and their material and moral rights are protected by law. The rights of the work owner are defined under the Law on Intellectual and Artistic Works No. 5846 as follows:
1. Economic Rights (Material Rights)
These are the rights that enable the work owner to benefit economically from their work:
✔ Adaptation Right: The authority to transform, adapt, or alter the work, such as translating, screenwriting, arranging, or making adaptations.
✔ Reproduction Right: The authority to produce and reproduce copies of the work in printed or digital form.
✔ Distribution Right: The authority to sell, distribute, and commercially circulate the work.
✔ Public Performance Right: The authority to present the work in theaters, concerts, exhibitions, or other settings.
✔ Communication to the Public Right: The authority to broadcast or transmit the work to the public through television, radio, the internet, and similar means.
✔ Share and Resale Right: The right of the owner of a work of fine art to receive a percentage when the work is resold after the first sale.
2. Moral Rights (Personal Rights)
These are non-transferable rights that are connected to the personal integrity of the work owner:
✔ Right of Public Disclosure: The authority to decide whether to make the work public or keep it confidential.
✔ Right of Attribution: The right of the work owner to demand that their name be attributed to the work.
✔ Right to Prevent Modification: The right of the work owner to prevent unauthorized changes or alterations to their work.
✔ Rights Against the Physical Custodian or Owner: The right of the work owner to prevent mistreatment of the work by physical custodians (e.g., museums, collectors).
