Commencement of Protection
✅ In Case of Commercial Use:
An application must be made within 2 years from the date the integrated circuit topography is first placed on the market. In this case, the protection period starts from the market release date.
✅ In the Absence of Commercial Use:
If the integrated circuit topography has not been commercially released, the protection period starts from the date the application is filed.
How Long is the Protection Period?
The protection period is 10 years.
This period ends at the end of the tenth calendar year from the commencement date.
Things to Consider:
If the integrated circuit topography has not been commercially used, except in cases requiring confidentiality, and if no registration application is made within 15 years from the date of its design, the protection right cannot be claimed.
