Definition of Patent

A patent is a legal protection document that grants the inventor the right to use, produce, sell, and import their invention for a certain period of time, in exchange for a detailed description of the invention. This document grants the inventor exclusive rights to manufacture, use, sell, or import the patented product for a specific period (usually 20 years).

What is Patent Right?

Patent rights are an important part of industrial property rights. They contribute to technology transfer and are of significant importance, particularly for developing countries.

For an invention to be patentable, it must meet the following criteria:

  • Inventive Step: It must involve a technical development that is not obvious to a person skilled in the relevant technical field.
  • Industrial Applicability: It must be capable of being produced or used in any industry, including agriculture.

  • Expiration of Protection Period (After 20 years)
  • Waiver of Rights by the Patent Holder
  • Non-payment of Annual Fees

Scope of Patent Protection

A patent application or registration is determined by the claims. The description and drawings are used as the basis for interpreting the claims.
