Conditions of Variety Protection

Requirements for New Plant Variety Registration

In order for a new plant variety to be registered, it must fulfil the following criteria:

1 Newness:

The propagation or harvested material of the variety must not have been offered for sale or put into use for a certain period of time before the date of application:

Domestic Within the last 1 year

Abroad In the last 4 years

For Trees and Vines: In the last 6 years

2 Distinctiveness:

It must be clearly distinguishable from other varieties known to the public at the time of application.

3 Uniformity:

The variety should show uniformity in terms of relevant characteristics, except for possible variations due to the propagation method used.

4 Stabilisation:

Relevant characteristics should remain unchanged throughout the multiplication periods.

5 Nomenclature:

-When a protected variety is registered, it becomes its official name. Anyone selling or marketing propagation material of the variety must use this name.

-The name of the variety must be such as to avoid confusion with another variety of the same botanical species.
