- Exclusive Rights on New Plant Varieties Protection of New Plant Varieties and Breeder's Rights Exclusive rights are granted to individuals who breed, discover, or develop a new plant variety. New, distinct, uniform, and stable plant varieties are protected under the Law No. 5042 on the Protection of Breeder's Rights for New Plant Varieties. Requirements for Breeder's Rights • Newness: The propagation or harvested material of the variety, backwards from the date of application One year domestically, It must not have been sold or made available to the public abroad for 4 years (6 years for trees and vines) by or with the authorisation of the right holder. • Distinctiveness: It must be clearly distinguishable from other varieties known to the public at the time of application. • Uniformity: The variety should show uniformity in terms of relevant characteristics, except for possible variations due to the propagation method used. • Stabilisation: Relevant characteristics should remain unchanged throughout the multiplication periods.
